Co-Owned Homes in West U: Deeds, Court Orders and Court Records

Updated October 2026

What happens in West U when a co-owner of a house will not agree to sell?

In September 2026, any West U co-owner can ask a Harris County district court to partition the house, a suit the Texas Rules of Civil Procedure govern.

What do Texas law and the deed say when one co-owner of a West U house will not sell?

Under Chapter 23 of the Texas Property Code, a joint owner of real property may compel a partition among the joint owners. The suit is brought in a district court of a county in which any part of the property is located.

The Texas State Law Library's court rules guide says the Rules of Civil Procedure govern the proceedings in civil trials. A partition suit runs under those rules as well as under Chapter 23.

Where the house was inherited, the court first decides whether it is heirs' property. If it is, Chapter 23A governs the partition, unless all of the cotenants agree otherwise in a record. Chapter 23A treats a sale as the last step rather than the first.

The court next sets fair market value, usually by ordering an appraisal. Where every cotenant has agreed to a value or to a method of valuation, the court adopts that instead. Any cotenant who did not ask for a sale may then elect to buy out those who did. That election is due within 45 days from the date the court's buyout notice is sent.

If the buyout does not clear, or a cotenant who asked for partition in kind remains, the court looks at dividing the property. It orders partition in kind unless it finds that division would cause substantial prejudice to the cotenants as a group. Where commissioners divide the property and the court confirms their report, the decree gives each recipient a title equivalent to a warranty deed from the other parties.

The deed is a separate question from who owns the house. The Texas State Law Library's probate guide on deeds says title is ownership of the property, and a deed is the legal document that transfers that ownership. The guide attaches a condition to its statement about heirs and the deed.

Which of those steps a particular file reaches is a question for a lawyer who has read the deed records and the estate file.

If the estate didn't go through the probate process or was settled informally, the heirs may not be listed on the deed, but still own all the rights to the property.

Where do the court records for a partition suit over a West U house sit?

West University Place lies in Harris County, so a partition suit over a house inside the city is filed in a Harris County district court. The Texas State Law Library's court records guide says Texas has no single database for searching all court records statewide.

That guide says each court is responsible for keeping its own records. It names Harris County among the larger counties with online databases.

The same guide says most case files, court records, docket sheets and trial dates are considered public records. The filings and trial dates in a partition suit over a West U house will usually be open to the public, including any buyer weighing an offer.

Ask the lawyer on the file for the court and the cause number. With those, the docket sheet shows what has been filed and when the court has set the case.

Which facts about a West U lot have to be on the record before anyone argues about value?

Where Chapter 23A applies, the court-appointed appraiser values the whole parcel assuming sole ownership of the fee simple estate. On a West U lot, three facts of record move that number. A market valuation of the address rests on the same three.

The first is the date the building site took its present boundaries. A site established before 24 October 1987 is an old building site, and in the Single-Family District it may be as small as 5,000 square feet. A site created after that date needs 8,250 square feet, with 75 feet of width and 110 feet of depth.

The second is the site's own width, depth and area, read from the recorded plat. Those set the envelope a builder works inside. At least 45 percent of the site must stay open and 35 percent pervious, and framed area is capped at 80 percent. A principal building stops at two and a half storeys and 35 feet, or 25 feet inside the rear yard.

The third is a survey of the large trees on the site. A large tree starts at 19 inches of circumference. Once a permit for development or predevelopment activity is in play, every large tree on the site is protected. The building official may not issue that permit until the urban forester has approved a tree survey.

Whether a site is old or new is settled from the recorded plat and the city's Community Development office at 3826 Amherst Street. No public record contains a land price, so the value of the site to a builder is a valuation rather than a statistic.

Market figures give context only. The median sale price is $1,899,513 across homes sold since April 2026, as of October 2026, in the market covering West University Place and the Southside area beside it. A median mixes original houses with new ones, so it describes a band rather than one address.

Who handles a court-ordered sale of a co-owned West U house?

Paige Martin of Real Broker, LLC specializes in court-ordered sales, including sales that require both parties to approve. Her files also include probate and estate sales, sales made by a trust, and inherited property with several heirs.

Over $200 million of West University real estate sold since 2015.

On any court-ordered sale here, ask the agent which kind of building site the house sits on and which document proves it. Ask how the house value and the site value were each reached, and which comparable sales sit behind them.

A court-ordered appraisal and a market valuation of the address are separate exercises. To see the house value and the site value side by side, ask for a home valuation. Send the address, the recorded plat and any tree survey you already hold.

Questions & answers

West U questions, answered

If one co-owner of our West U house dies, does the other owner automatically get that share?

Only where the owners signed a survivorship agreement. Under the Texas State Law Library's nonprobate property guide, where joint owners have signed a survivorship agreement, the survivor automatically inherits the deceased owner's share. The same guide says that agreement may be part of the deed or signed at a later time. So read the deed first, then look for any separate agreement the owners signed after it.

Where no survivorship agreement was signed, the automatic rule in that guide does not reach the house. The deceased owner's share then passes through that owner's estate. It may end up with heirs rather than with the surviving owner. If the surviving owner and those heirs cannot agree on a sale, any of them can turn to a partition suit. A lawyer who has read the deed, any later agreement and the estate file is the person to say which route applies.

Can my co-owner just sign a quitclaim deed to hand me their share of the West U house?

Ask a lawyer before anyone signs one. The Texas State Law Library's guide on transferring real property under a court decree says that in many states a quitclaim deed can be used to transfer property. The same guide then warns that using this form in Texas can cause problems with the chain of title. The right instrument for a transfer between co-owners is a question for the lawyer drafting it.

The warning sits in the guide's page on court decrees, which is where a disputed co-ownership often ends up. A West U house that changes hands between co-owners will usually be sold again someday. Every instrument recorded against it stays in its history. Have the lawyer read the existing deed records for the house before choosing the form, so the transfer fits what is already on file.

Can Harris County put my name on the deed of a West U house I inherited?

No. The Texas State Law Library's probate guide on deeds says the county cannot add your name to the old deed or issue a new deed with your name on it. Ownership and the paper record are two separate questions in that guide. Where the estate skipped probate or was settled informally, the same guide says heirs may be missing from the deed yet still hold all the rights.

That gap shows up when a sale is proposed, because someone has to establish who must sign. Which document settles ownership in a particular estate is a question for a lawyer who has read the will and the deed records. Where the owners cannot agree among themselves, the route the Texas Property Code offers is a partition suit, filed in the county where the house stands.

Are there court rules beyond the statewide ones for a partition suit over a West U house?

Possibly. The Texas State Law Library's court rules guide says that at a local level, lower courts often adopt local rules for court proceedings in their jurisdictions. A partition suit over a West U house is heard in Harris County. The court hearing it may therefore work under its own local rules on top of the statewide ones. The lawyer on the file is the person to confirm which apply.

Once a suit is filed, ask the lawyer which court holds the file and which local rules that court has adopted. Deadlines and filing steps can depend on them. Orders made in the case stay with that court, since the same library's court records guide places record-keeping with each individual court rather than with one statewide office.

Could a court split a co-owned West U lot into two lots instead of ordering a sale?

Under Chapter 23A of the Texas Property Code, partition in kind means dividing heirs' property into physically distinct and separately titled parcels. On a West U lot, the city's own minimum dimensions limit that. In the Single-Family District, a building site created after 24 October 1987 has to reach 8,250 square feet, 75 feet wide and 110 feet deep.

Where the court does order partition in kind, the Texas Property Code lets it require one or more cotenants to pay others. Those payments make the division just and proportionate in value to the fractional interests held. Two or more parties may also ask to have their interests aggregated, and the court shall approve that request when it considers dividing. Whether one West U site could be divided at all turns on its width, depth and area against the city's minimums, read from the recorded plat.

If a court orders our co-owned West U house sold, will it be auctioned?

Where the house is heirs' property, normally it goes on the open market. Under Chapter 23A of the Texas Property Code, a court-ordered sale of heirs' property must be an open-market sale. The exception is where the court finds that sealed bids or an auction would be more economically advantageous and in the best interest of the cotenants as a group. That finding belongs to the court alone.

A broker appointed to offer heirs' property on the open market reports to the court within seven days of receiving an offer at or above the value the court determined. Other partition law can require that report sooner. On a West U house, both the court's value and any offer are read against the same facts of record: the site date, the dimensions and the trees.
