Texas contract forms for selling one home and buying another
Selling a West U House and Buying a Condo: Texas Forms That Link the Two Deals
Updated October 2026
How do you line up selling a West U house with buying a condo in Houston?
In October 2026, Texas buyers who cannot buy a condo unless their West U house is sold and closed use the Addendum for Sale of Other Property by Buyer.

What decides who bids on the West U house you are selling?
West University Place is an independent Texas city of about two square miles. It enforces its own zoning ordinance, and that ordinance decides what a buyer could build on your lot.
Three facts about the site come first, and each is a matter of record. They are the date the building site was established with its present boundaries, its width, depth and area, and the large trees standing on it.
A site established before 24 October 1987 can be as small as 5,000 square feet in the Single-Family District. A site created after that date needs 8,250 square feet, 75 feet of width and 110 feet of depth.
Those facts sort the buyers. One group pays for the house as it stands and compares it with new construction. The other pays for the site and has read the plat, the dimensions and the trees before it calls.
A larger house that already fills most of the permitted framed area, capped at 80 percent of the site, gives a builder little reason to replace it. A smaller original house on a full-size site is the reverse case.
That split matters on the condo side too. It sets which kind of sale you are running, and the two kinds run on different timelines.
Which Texas forms tie the condo purchase to the sale of your West U house?
The Texas Real Estate Commission promulgates an Addendum for Sale of Other Property by Buyer. The Commission states that it is used if the buyers will be unable to buy the new property unless their existing property is sold and closed.
On this move, the new property is the condo and the existing property is your West U house. The condition has two parts: the house has to be sold, and that sale has to close.
For a resale condo, the Commission's promulgated form is the Residential Condominium Contract (Resale), listed as Form 30-18 with an effective date of 07/01/2026.
Two contracts and an addendum leave room for error. The Commission's forms list warns that mistakes in the use of a form may result in financial loss or a contract which is unenforceable.
Under 22 Texas Administrative Code Section 537.11, a license holder may explain the informational items and choices in a form. The same rule bars drafting or recommending language that affects the parties' rights, obligations or remedies, including contingency clauses. Wording beyond the form's printed choices is for your attorney.
This Addendum is used if the Buyers will be unable to buy the new property unless their existing property is sold and closed.
What do the West U market figures say about timing the two deals?
The median home went under contract after 38 days, and homes closed at about 99.2 percent of asking. 209 homes sold in the trailing twelve months, against about 4.4 months of inventory. Figures as of October 2026.
The median sale price is $1,899,513, measured across homes sold since April 2026, at an average of $542 per square foot.
Those figures cover West University Place together with the Southside area beside it. A median also blends original houses with new ones, so it gives your plan context rather than a closing date.
The spread inside the median follows the house-or-lot split. A sale to a buyer who has already underwritten the site runs differently from a sale that competes with new construction on quality.
Questions & answers
West U questions, answered
Which TREC lease form goes with the sale of my West U house?
TREC's forms list names the Seller's Temporary Residential Lease as Form 15-7, with an effective date of 01/05/2026. The Commission promulgates no residential leases other than temporary residential leases used in connection with a sale. A temporary lease tied to the sale of your West U house has a promulgated form. An ordinary residential lease does not.
The number and the date matter because a form number changes when the Commission revises the form. Work from the version on the Commission's own current listing, not from an older copy someone saved. Who occupies the house, for how long and on what terms are written into the lease itself. Have an attorney read those terms before you sign, because a lease attached to a closing binds you the same way the sale contract does.
Does TREC publish a form for my West U listing agreement or my condo buyer agreement?
No. TREC's forms list states that it does not promulgate listing or buyer representation agreements. The same exclusion covers property management contracts and forms for commercial property. The agreement you sign to list your West U house, and the one you sign with an agent for the condo search, are not Commission forms.
The Commission describes a buyer representation agreement as a private contract between a real estate broker and a buyer, and it does not regulate one. Since 1 January 2026 a license holder working for a prospective buyer of residential real property must enter a written agreement with that buyer before showing any. In that statute, residential real property includes a unit in a multiunit residential structure where title passes under a condominium or cooperative system. Read each agreement before you sign it, and take any change you want to an attorney.
Will a condo seller still look at other offers while mine waits on my West U sale?
The Commission's page for the Addendum for Sale of Other Property by Buyer states that a seller may receive, review and negotiate several offers simultaneously. An offer that depends on your West U house being sold and closed is one offer among the ones a seller may weigh. What the condo seller may do once a contract is signed sits in that contract and its addendum.
The same line applies on your side of the move. As the seller of the West U house, you may receive, review and negotiate several offers at once. Here those offers can come from two kinds of buyer, one paying for the house and one paying for the site. A license holder may explain the choices printed in the addendum. A license holder may not give an opinion on its legal effect, so that reading belongs to your attorney.
If a builder buys my West U house, what does the city's permit sequence add to the offer?
The builder carries the city's sequence and prices it into the offer. Plan review for a new home runs about 10 to 15 business days. The urban forester's tree review adds about 5 to 7 more, and a rejection resets plan review in full. The building official issues no development permit until the forester has approved a tree survey.
Before the permit is released, the city wants an active water account in the contractor's name and sidewalk and driveway deposits. It also wants utility disconnections with a letter from the gas utility, and an approved final demolition inspection. Inspections in that sequence run on Tuesdays and Thursdays only. A large tree starts at 19 inches of circumference, and every large tree on the site is protected once a development permit is in play. A builder underwrites all of it before naming a number, so the sequence is already inside the price you are offered.
How do I find out what my West U house is worth before I commit to a condo?
Ask for a home valuation on the address. It gives two readings: what a buyer would pay for the house as it stands, and what the site is worth to someone who would replace it. No public record carries a land price, so the second reading comes from the plat, the site's dimensions and its trees.
Send the address, along with the plat and any tree survey you already hold. What comes back is the site facts, the comparable sales, and a written statement of which value is doing the work. The source of each figure is named beside it. Knowing that number before you sign on a condo tells you what your purchase is waiting on when the sale of the house is its condition.
Who can handle my West U sale and my condo purchase together?
Paige Martin of Real Broker, LLC specializes in condo purchases and purchases in an association-governed building. On the West U side, her work starts from one question: is the house worth more as a house or as a lot? Over $200 million of West University real estate sold since 2015.
Judge any agent on two tests, one for each deal. On the house, can they say which kind of building site it sits on and name the document that proves it? On the condo, can they name the TREC form for the purchase, the addendum that ties it to your sale, and the effective date of each? Both answers are matters of record, and you can check them yourself before you hire anyone.
